As per the Director of Public Prosecutions directive dated 15 January 2026, the accused are facing Kidnapping and Attempted Murder charges in the Regional Court. All murder charges were abandoned due to insufficient evidence. Full document available here.

Key Facts – The Luke Edwards Case

  • Luke Edwards did not die at Tetelestai Recovery Centre. He successfully absconded from the facility on the evening of 8 April 2025.
  • Luke was alive and uninjured hours later. At 01:30 on 9 April 2025, he was captured on high-definition CCTV at the neighbouring Mooi Hawens property — fully clothed, coherent, and interacting with security personnel.
  • His body was found on Mooi Hawens property. At approximately 05:20 on 9 April 2025, Luke’s body was discovered inside the boundaries of the Mooi Hawens retirement village — not on TRC grounds.
  • The Magistrate granted bail because there was no evidence against the accused. During the bail hearing, the court found insufficient evidence to keep the accused in custody, resulting in bail being granted on 9 July 2025.
  • Official investigations cleared TRC. The KwaZulu-Natal Department of Health conducted a formal investigation and found no evidence directly implicating Tetelestai staff in any wrongdoing (Report dated 1 July 2025).
  • Murder charges were dropped. On 15 January 2026, the Director of Public Prosecutions abandoned all murder charges due to insufficient evidence. The remaining charges relate only to events on 7–8 April and do not involve homicide.
  • Tetelestai Recovery Centre was a registered and compliant facility. At the time, TRC held valid CIPC, NPO, DSD, DOH Health Certificate, Fire Safety Certificate, and municipal approvals, and employed qualified medical and counselling professionals.

Conclusion First: The Verifiable Facts

Luke Edwards absconded from Tetelestai Recovery Centre (TRC) on 8 April 2025. The abscondment was officially reported at 23:06 on the TRC internal communications system. From that moment, Luke was no longer in TRC's care or custody.

CCTV proves he was alive and uninjured at 01:30 on 9 April 2025 at the front gate of Residentia Mooi Hawens — a separate, fenced retirement facility adjacent to TRC. Security footage shows Luke clothed, coherent, without visible wounds, conversing with security and drinking water.

His body was discovered at 05:20 inside the Mooi Hawens property — deep within the retirement home's fenced premises, not at TRC. The last person to see Luke alive was the Mooi Hawens security guard. The last confirmed location of Luke while alive was Mooi Hawens.

Prosecutorial Decision — 15 January 2026

The Director of Public Prosecutions (DPP) officially abandoned all murder charges against all accused. The reason cited was no evidence to proceed with murder charges against anyone. Charges were reduced to Attempted Murder (relating to 7–8 April incidents at TRC) and Kidnapping only. On 24 April 2026, the State Prosecutor confirmed this abandonment in open court.

Luke absconded on 8 April 2025 at approximately 23:06. He was no longer under TRC custody. His death occurred at a separate facility — Residentia Mooi Hawens — over four hours after CCTV captured him alive at its gate.

At 01:30 on 9 April 2025, Mooi Hawens security cameras recorded Luke Edwards clothed, without visible injuries, speaking coherently with security personnel. This contradicts any narrative of assault at TRC.

Sgt. Khanyase testified under oath on 9 July 2025 that Luke's body was found "lying dead inside the Mooi Hawens" old age centre. The Department of Health investigation confirmed the same location.
